By accessing or using VisibilityTool.AI, you agree to be bound by these Terms of Service. VisibilityTool.AI is operated by Axeman Technology Solutions LLP. If you do not agree to these terms, you must not access or use the service. These terms constitute a legally binding agreement between you and Axeman Technology Solutions LLP governing your use of the platform.

2. Description of Service

VisibilityTool.AI is an AI visibility measurement tool that analyzes your brand's presence and authority across major large language models, including ChatGPT, Claude, Gemini, and Perplexity. The service calculates proprietary metrics including Latent Brand Association, LLM Authority Score, Top of Mind, Semantic Self-Sufficiency, and Citation Capture Rate.

The service is currently in an early access and waitlist phase. Features, metrics, and functionality may change as the platform evolves. We reserve the right to modify the service at any time without prior notice.

3. Account and Authentication

To use VisibilityTool.AI, you must:

• Possess a valid Keywords Everywhere API key for authentication
• Provide accurate and current information during the authentication process
• Maintain the confidentiality and security of your API key and account credentials
• Notify us immediately of any unauthorized use of your account

Each Keywords Everywhere user ID is limited to one VisibilityTool.AI account. You are solely responsible for all activity that occurs under your account.

4. Acceptable Use

When using VisibilityTool.AI, you agree that you will not:

• Abuse, overload, or interfere with the proper functioning of the service
• Attempt to manipulate, falsify, or artificially inflate visibility scores or metrics
• Scrape, crawl, or extract data from the service through automated means without authorization
• Reverse engineer, decompile, or disassemble any part of the service or its underlying technology
• Use the service for any illegal, fraudulent, or unauthorized purpose
• Share, transfer, or sublicense your account access to third parties
• Attempt to gain unauthorized access to other users' accounts or data

5. Intellectual Property

Axeman Technology Solutions LLP retains all rights, title, and interest in and to the VisibilityTool.AI service, including but not limited to:

• The platform's software, code, and architecture
• Our proprietary metrics methodology and calculation algorithms
• The VisibilityTool.AI brand, name, logos, and related trademarks
• All documentation, designs, and content created by us

Your data -- including brand information, competitor lists, and any content you submit for analysis -- remains your property. By using the service, you grant us a limited license to process your data solely for the purpose of providing the service to you.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. Axeman Technology Solutions LLP expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

AI visibility scores and metrics are estimates based on the observed behavior of large language models, which are inherently probabilistic and subject to change. We do not guarantee the accuracy, completeness, or reliability of any scores, rankings, or analysis results. LLM responses vary between queries, and model behavior may change due to updates by their respective providers.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AXEMAN TECHNOLOGY SOLUTIONS LLP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY.

In no event shall our total aggregate liability exceed the amount you have paid to us, if any, for use of the service during the twelve (12) months preceding the claim.

8. Service Modifications

Axeman Technology Solutions LLP reserves the right to modify, suspend, or discontinue the service (or any part thereof) at any time, with or without notice. This includes but is not limited to:

• Adding, changing, or removing features and functionality
• Adjusting metrics and calculation methodologies as LLM technology evolves
• Changing supported LLM providers
• Modifying pricing, usage limits, or plan structures

We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the service.

9. Termination

We may suspend or terminate your access to the service at any time, with or without cause, including but not limited to violation of these Terms of Service. Upon termination, your right to use the service ceases immediately.

You may terminate your account at any time by contacting us. Upon termination, we will delete your account data in accordance with our Privacy Policy.

Sections relating to intellectual property, disclaimers, limitation of liability, and governing law shall survive termination of these terms.

10. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from or relating to these terms or the service shall be subject to the exclusive jurisdiction of the courts in India.
